Indian Copyright Act Policy
Welcome to GST Jan Seva Kendra (the “Site”). We are committed to respecting and protecting intellectual property rights — both our own and those of others. This Copyright Policy outlines our position and procedures regarding copyright ownership, infringement claims, counter-notices, and repeat infringers, as per the Indian Copyright Act, 1957.
1. Copyright Ownership
Under Section 13 of the Copyright Act, 1957, GST Jan Seva Kendra reserves exclusive rights to all original content available on this website. This includes, but is not limited to:
- Website content
- Computer programs and software
- Customer Relationship Management (CRM) tools
- Demo materials and presentations
- Training manuals and guides
- Blog posts and articles
These works are protected as literary works under Indian copyright law. The copyright owner has exclusive rights under Section 14 of the Act, which include:
- The right of adaptation
- The right of reproduction
- The right of publication
- The right to make translations
- The right to communicate content to the public
- The right to distribute or license the work
These rights may only be exercised by the copyright owner or a person who has been explicitly authorized through a license agreement.
2. Filing a Copyright Infringement Claim
If you believe that your copyrighted work has been used or copied in a way that constitutes copyright infringement, you may submit a Notice of Infringement to us.
To be effective under the law, your notification must include the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.
- Clear identification of the copyrighted work that you claim has been infringed.
- Sufficient information about the infringing material, including the URL or exact location of the allegedly unauthorized content on our Site.
- Your full contact details — name, physical address, phone number, email address, and fax number (if available).
- A statement that you believe in good faith that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- A declaration that the information provided in your notice is accurate and, under penalty of perjury, that you are the rightful owner or are authorized to act on behalf of the owner.
Please send your notice via our “Contact Us” page. We highly recommend using email for faster processing.
Important: When submitting a notice, you agree that GST Jan Seva Kendra may share your identity and information with the individual or organization responsible for the alleged infringement.
3. Counter-Notification Procedure
If you have received a notice from us indicating that your content was removed or disabled due to a copyright claim, and you believe this action was a mistake or misidentification, you may file a Counter-Notification to request reinstatement.
Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its prior location on the Site.
- A statement, made under penalty of perjury, that you believe the content was removed due to error or misidentification.
- Your full name, address, telephone number, and a declaration that you consent to the jurisdiction of the relevant Indian judicial authority. If you are outside India, you must consent to jurisdiction in any district where the service provider is located, and agree to accept service of process from the party that submitted the original infringement notice.
Counter-notifications should also be submitted via our Contact Us page. Use of email is strongly encouraged for timely communication.
4. Repeat Infringer Policy
GST Jan Seva Kendra follows a strict repeat infringer policy. By the Copyright Act, we keep a record of all infringement notices received. Users who are found to repeatedly infringe upon copyrights — either through uploaded content or other means — may have their accounts suspended or permanently terminated.
We strive to act in good faith and promptly respond to all valid copyright complaints. However, we also support users’ rights to fair use and due process.
5. Modifications to This Policy
We reserve the right to modify this Copyright Policy at any time and for any reason. Updates will be reflected on this page, and it is the responsibility of users to review this policy periodically. Continued use of the Site after changes implies acceptance of the updated terms.
If you have any questions about this Copyright Policy or require further clarification, please do not hesitate to contact us through our Contact Us page.
GST Jan Seva Kendra thanks you for your cooperation in maintaining a respectful and lawful environment for content creators and users alike.
